Conciliation
Conciliation is a conflict resolution process where an impartial person (the conciliator) assists the parties to a dispute in reaching a mutually satisfactory agreed settlement of the issues in dispute. Steps include appointment of conciliator, submission of briefs, meetings with parties, and finding a mutually agreed solution.
Arbitration
Arbitration is a technique in which a third party reviews the evidence in the case and imposes a decision that is legally binding for both sides and enforceable. Steps include selecting the arbitrator, preparing arguments and evidence, holding hearings, and awaiting a decision.
Peer Mediation
Peer mediation is a process by which trained student volunteers help their peers resolve conflicts amicably. Steps include training mediators, disputants presenting their view point, identification of interests, negotiation, and reaching an agreement that satisfies both parties.
Facilitation
Facilitation is a process by which a person, the facilitator, helps a group improve how it identifies and solves problems and makes decisions, to increase the group's effectiveness. Steps include preparation, setting the agenda, guiding the meeting, promoting effective communication, and ensuring equitable participation.
Negotiation
Negotiation is a dialogue between two or more people with the intention of reaching a beneficial outcome over one or more issues where conflict exists. Steps involved include preparation, discussion, clarification of goals, negotiate towards a win-win outcome, agreement, and implementation of a course of action.
Collaborative Law
Collaborative law is a legal process enabling couples who have decided to separate or end their marriage to work with their lawyers and, on occasion, other family professionals in order to avoid the uncertain outcome of court and to achieve a settlement that best meets the specific needs of both parties and their children. Steps include each party hiring a collaborative attorney, engaging in four-way meetings, negotiations, and creating a mutually agreeable settlement.
Restorative Justice
Restorative justice is a system of criminal justice that focuses on the rehabilitation of offenders through reconciliation with victims and the community at large. Steps include identifying and taking steps to repair harm, involving all stakeholders, and transforming the traditional relationship between communities and their governments in responding to crime.
Mediation
Mediation is a conflict resolution process by which a third party helps disputing parties to find a mutually satisfactory solution. Steps include introductory remarks, statement of the problem by the parties, information gathering, identification of the problems, bargaining and generating options, and finally, reaching an agreement.
Conflict Coaching
Conflict coaching is a one-on-one process that helps individuals in a dispute understand their conflict management style, increase their ability to manage conflicts, and work through a specific dispute. Steps include assessing conflict management style, setting goals, exploring strategies, and action planning.
Therapeutic Jurisprudence
Therapeutic jurisprudence proposes that law should be used to promote the mental and physical well-being of the citizens it serves. Steps include recognizing the impact of law on emotional life and psychological well-being, aiming to improve legal processes to consider these impacts, and applying this approach to legal disputes.
