Removal Proceedings
The legal process by which non-citizens are formally removed from the US, including hearings before an immigration judge and potential appeals.
Notice to Appear (NTA)
A document issued by the U.S. government to a non-citizen informing them that deportation proceedings are being initiated against them and requiring them to appear before an immigration judge.
Bond Hearing
A proceeding before an immigration judge where the detainee can request to be released on bond while their immigration case is pending.
Immigration Bond
A form of legal guarantee paid to secure the temporary release of an individual detained by Immigration and Customs Enforcement (ICE) while they await their immigration court proceedings.
Voluntary Departure
An option in removal proceedings where an individual elects to leave the U.S. at their own expense within a specified period, avoiding some of the legal consequences of formal removal.
Expedited Removal
A fast-track deportation process that allows immigration officers to remove an individual without a hearing before an immigration judge if they are caught soon after entering the U.S. or have no valid immigration documents.
Credible Fear Interview
An initial assessment used in expedited removal proceedings where an asylum officer determines if an individual has a credible fear of persecution or torture in their home country.
Detention Center
A facility where immigrants are held while waiting for their cases to be processed or for deportation if they are found to be unlawfully present in the country.
Asylum Seeker
An individual who has fled their home country and is seeking protection in another country because of persecution or a well-founded fear of persecution based on race, religion, nationality, political opinion, or membership in a particular social group.
Detainer
A request issued by ICE to a local law enforcement agency to hold an individual for up to 48 hours after their release date, to allow ICE to take custody of them for possible deportation.
