Federal Rules of Evidence: Article XI
4
Flashcards
0/4
Rule 1101 - Applicability of the Rules
This rule clarifies which proceedings the Federal Rules of Evidence apply to. It lists specific proceedings where these rules are applicable, including trials and hearings, and those where they're partly or wholly inapplicable, such as grand jury proceedings.
Rule 1102 - Amendments
Rule 1102 establishes the procedure by which the Rules of Evidence can be amended. Amendments must be reported to Congress by the Supreme Court and will take effect unless Congress enacts legislation to reject, modify, or defer them.
Rule 1103 - Title
Rule 1103 determines that the official title for these Rules is 'Federal Rules of Evidence.' This might seem straightforward, but it's there to avoid ambiguity or confusion regarding references to these rules in legal documents and discussions.
Rule 1104 - Case Law
While not an official rule, Rule 1104 is sometimes referenced to indicate that the Federal Rules of Evidence don't supersede case law unless they are in direct conflict. It guides the interpretation of the rules in harmony with established precedents.
