Real Evidence
Real evidence refers to material, tangible evidence such as objects, which play some actual role in the matter that gave rise to the litigation.
Circumstantial Evidence
Circumstantial evidence is evidence that relies on an inference to connect it to a conclusion of fact—such as a fingerprint at the scene of a crime.
Demonstrative Evidence
Demonstrative evidence is evidence in the form of a representation of an object. This could be charts, maps, photographs, and other devices intended to help the judge or jury better understand the factual matters of the case.
Digital Evidence
Digital evidence consists of information or data of probative value that is either stored or transmitted in a digital form. This can include emails, text messages, hard drives, and information from social media sites.
Direct Evidence
Direct evidence supports the truth of an assertion directly without an inference or presumption and which, if true, conclusively establishes that fact.
Testimonial Evidence
Testimonial evidence is any spoken evidence presented by a competent witness under oath or affirmation in a legal proceeding.
Documentary Evidence
Documentary evidence includes any type of written, recorded, or photographically preserved materials that are presented to establish facts in a case.
Hearsay Evidence
Hearsay evidence is a statement that was made outside of the courtroom by someone other than the witness reporting it, offered to prove the truth of the matter asserted.
